Adoption of procedures to reduce paper consumption

Byambasuren, and M. Bayasgalan.

BASED ON:

Due to the rapid development of information and communication technology in the world, our country is working on the goal of introducing technical and technological development into life, making technological progress accessible, fast and safe to citizens, reducing the use of paper, and becoming an environmentally friendly "E-Nation".

"Vision 2050" as part of Mongolia's long-term development policy in 2021-2030, in section 5.1.9 "Introduce electronic technology to court operations, make operations quick and hassle-free" and in section 5.3.17 "Information in public institutions" , introducing the appropriate use of communication technology, sharing and promoting good practices among organizations, etc.

According to Article 71, 71.1.11 and Article 74, 74.1.6 of the Law on the Courts of Mongolia, the General Council of the Court, by Resolution No. 332 dated December 7, 2022, "Introduction of new integrated forms of information technology, court services, and management in courts" policy" was approved.

Within the framework of the above policy document, it is intended to increase the level of electronic transition of court and judicial administrative activities using information technology and innovation, reduce the use of paper, and reduce administrative costs. In addition, according to the Law on State Savings dated April 29, 2022, the government and its organizations at all levels must implement financial discipline in their operations, increase efficiency, save on clerical costs, and transfer paperwork and records to electronic format on the organization's intranet. provided to save paper, copier and printer toner costs.

Therefore, in order to reduce the use of paper, limit wastage, reduce administrative costs, save time, and facilitate work, it is appropriate to adopt the "Paper Use Reduction Procedure" in the internal work organization of the court.

19.2.1 of Article 19 of the Law on Courts of Mongolia and 15.2.3 and 15.2.4 of Article 15 of the Law on State Savings respectively

DETERMINE:

 

1. "Procedure to reduce paper consumption" should be approved as an attachment.

 

2. Judge G. Davaadorj and the Secretariat should be instructed to ensure the organization and implementation of the resolution.

 "PROCEDURE TO REDUCE PAPER CONSUMPTION"

 1. General conditions

1.1 The purpose of this procedure is to reduce the use of paper used in the court's internal operations, or not to use paper for court session notes, probative drafts, first instance court decisions, and issues to be discussed by judges, to reduce administrative costs, and to facilitate the work of judges, assistant judges, and secretaries. , to save time, to effectively support court digitalization, and to start introducing environment-friendly applications.

2. Reduce the use of paper

2.1 Review the minutes of the court session, the head of the case management department, and review the minutes of the court session electronically on the intranet. In case of corrections, the head of the 1st department of case management will highlight them in yellow, the speaker judge and his assistant in red, and the presiding judge in green.

2.2 When writing and reviewing drafts, orders, and resolutions, judges, assistant judges, and court members will review the drafts electronically via the intranet, and notices of court hearings will also be delivered to the court members electronically.

2.3 As soon as the probabilistic project is ready, the reporting judge and his assistant will send it to the head of the 1st department of case management via the intranet. The head of the department will check the technical errors like the date, number, structure, etc. of the probability and send it to the court.

2.4 In case of review and revision of the feasibility project, the head of the department will highlight it in yellow, the presiding judge in green, and the panel judge in light blue.

2.5 The materials to be discussed at the judges' consultation will be delivered electronically through the internal network in advance, and computers, notebooks, and tablets will be used during the consultation.

2.6 The judge's assistant shall submit the decision of the primary court, a sample of cases, and appeals to be reviewed at the hearing of the appeal court to the court panel appointed by lottery for the court hearing via the intranet. In this, the judge will use an electronic folder /FOLDER/ with his name, and that electronic folder has a privacy code. The judge and the judge's assistant are responsible for the confidentiality of the information in the electronic file.

2.7 The court panel appointed by lottery shall save the decision of the court of first instance received electronically via the intranet in an electronic folder with its name and use the computer, notebook, and tablet of its room, courtroom, and consultation room to read it.

2.8 The Office of the Court shall prepare activity reports, drafts of official documents, orders, and decisions for review by authorized officials, and when reviewed and corrected by authorized officials, review them electronically via the intranet.

2.9 Probability work percentages will be archived electronically.
